New draft - Plural Legal Orders and Human Rights 12 May 2009

The Council has posted a new draft report, titled Plural Legal Orders and Human Rights for comments and review.

The draft report is the result of more than a year’s research, and also draws on an Expert Meeting and two Research Workshops. It explores the challenges and questions posed to human rights policy and advocacy by plural legal orders.

The report begins by mapping legal plurality, the contemporary forces driving it and revisiting debates around law, culture and human rights. The report then takes a critical look at relevant human rights standards; non-state legal orders; and, the human rights impacts of plural legal orders. The latter half of the report includes an assessment of justice sector reforms; an analysis of frameworks to analyse legal plurality and concludes by offering guiding perspectives and a framework for human rights advocates to assess and engage with plural legal orders.
